This course reviews the Appraisal Clause in an insurance policy which allows a party to demand an appraisal of the loss when there is a disagreement. You will study sample Appraisal Clauses; the parties to the Appraisal process; and the standard nine (9) step Appraisal process. We also compare and contrast Appraisal with Arbitration and discuss when and how Appraisal is most effective and appropriate. This course has numerous Case Studies in it to keep the course both informative and interesting.
This course is meant to serve as a primer to bad faith in insurance claims law. Under the insurance contract or policy, insurance companies (insurers) have many duties to the insured, the policyholder (insured). In performing their duties, insurers owe a duty to the insured to act in good faith and to deal fairly with the insured, particularly in the claim handling process. The insurer’s improper and potentially egregious handling of an insured’s claim can lead to extra-contractual claims like bad faith claims. An insurance bad faith claim describes a claim that the insured may have against the insurance company for the insurer’s bad acts in not adhering to the implied covenant of good faith and fair dealing.
The purpose of this course is to educate you on blockchain technology and how it is affecting the insurance industry. In the first Module we are going to discuss a brief History and Overview of blockchain technology. In the second module we review the application of blockchain in the insurance industry. In Module Three we review some blockchain limitations as regards the implementation in the insurance industry (we also provide some recent insurance industry examples). In this course the student will study Claim Evaluations; the assessment of “the facts” pertaining to a loss and the interplay of coverages, policy language, and the law to determine a fair offer in accordance with the policy’s coverage and language and the controlling law. We review the parties in the Evaluation process, Claims Evaluation software, reserves and of course the totality of the Evaluation process. This course also includes information on claim’s fraud detection and prevention. The general focus of this course is on the Evaluation aspect of claims handling. Welcome to the Claim Investigations Legal brief continuing education course. This course studies the claims adjuster’s overarching purpose… “to fulfill the insurance company’s contractual promises and legal obligations”. An insurance claim is truly where the “rubber meets the road” as regards the promise made by the insurance company to indemnify the insured for either a first-party loss or third-party legal liability claim against the insured. You will review how claims adjusters fulfill their duty by completing the following activities: coverage verification, claims investigation, claims evaluation, and claims resolution. You will also study claims handling criteria: promptness and fairness; meeting the requirements of the law; meet the expectations of the insured; the control of claims administration cost; and control claims payment cost. The general focus of this course is on the Investigation aspect of claims handling. Interesting case law is presented to support the concepts discussed in the course.
